Tapas Mazumder v. State Of West Bengal And ORS.
August 10, 2021 ARDR (25) WPA 3886 of 2021 Tapas Mazumder Vs.
The State of West Bengal & ors.
Mr. Prasanta Kumar Pakrashi, ...for the petitioner.
Mr. Chandi Charan De, Mr. Chandana Ghosh, Mr. Anirban Sarkar, ...for the State.
The grievance of the petitioner is directed against the refusal of the State respondents to pay the petitioner compensation in respect of the alleged acquisition of the subject premises.
The petitioner relies on a letter dated 28th August, 2020 (Annexure P/4 to the petition) whereby the State respondents have requested the petitioner to prove the office with authenticated copies of relevant papers along with copies of C.A. Roll No. 2166 dated 6th December, 1968 at an early date.
Mr. De appears for the State respondents and relies on paragraph 7 of the petition to contend that the grievance of the petitioner has been redressed and the State respondents have sought for information from the petitioner which the petitioner has been unable to provide till date.
In view of the aforesaid, I am of the view that there is no scope for passing any order in favour of the petitioner in this petition.
The petitioner is granted liberty to approach the concerned District Magistrate and Collector and provide them with the necessary documentation as sought for in the letter dated 28th August, 2020. It is needless to mention that the respondent no.2 will act in accordance with law in considering the case of the petitioner.
With the aforesaid directions, WPA 3886 of 2021 stands disposed off.
