For the Respondent nos. 6 and 8 Affidavit of service filed by the petitioners and the report submitted by the State are taken on record. The petitioners allege that the private respondents are raising construction in their land without obtaining any sanctioned plan/permission from the concerned authority. It appears from the report submitted by the State that there is a long standing dispute between the petitioners and the private respondents and the private respondents claim to have purchased a share of the property from some of the cosharers. The private respondents attempted to raise construction in the land which was objected to by the petitioners. Upon intervention of the local Panchayat the construction work has been stopped. The land is lying vacant at present.

Upon consideration of the material on record, this Court is of the view that in the event the petitioners allege encroachment of their property or any portion thereof, they are at liberty to approach the appropriate civil forum for redressal of their grievance.

Nothing further remains to be adjudicated in the present application.

The writ petition is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
