Mr. Rahul Karmakar, learned counsel appears for the petitioner.

Mr. Soumitra Bandyopadhyay, learned counsel appears for the State.

The sole grievance of the petitioner is that, statutory appeal filed under Rule 51 of the West Bengal Minor Minerals Concession Rules, 2016 is pending before the appellate authority since long.

In view of the above, the appeal, annexure P-10 at page 64 to the writ petition shall be disposed of by the jurisdictional appellate authority after granting an opportunity of hearing to the parties thereto and then by passing a reasoned order in accordance with law within a period of eight weeks from the date of communication of this order.

It is made clear that, this Court has not gone into the merits of the rival contentions of the parties in the appeal. Parties shall be at liberty to urge their respective points before the appellate authority.

Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.

With the above observations and directions this writ petition, WPA 3406 of 2025 stands disposed of, without any order as to costs.
