Affidavit of service filed by the petitioner is taken on record.

The petitioners allege that the private respondents are raising construction without obtaining any sanctioned plan/permission from the concerned authority.

The petitioners submitted a representation before the concerned authority on 3rd November, 2025 which is yet to be considered. The petitioners pray for consideration of the said representation.

Learned counsel for the private respondents denies and disputes the allegation made by the petitioners. Learned counsel submits that the alleged construction has been raised under the Gramin Abas Yojana Scheme. In view of the fact that the representation submitted by the petitioners has not been considered by the concerned authority as yet, the Pradhan, Khorimachan Gram Panchayat, being the 8th respondent herein, is directed to consider and dispose of the representation

dated 3rd November, 2025 within four weeks from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the petitioners and the private respondents, in accordance with law.

The decision taken by the authority shall be communicated to the petitioners within a week thereof. The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
