The petitioner seeks to be renamed as State Aided College Teacher Category -II in terms of Memorandum dated 23rd December, 2019.

The Memorandum indicates a cut-off date of 13th July, 2019 in respect of teachers engaged in different Government/Government aided Colleges up to or before that date.

According to learned counsel appearing for the petitioner, there has been a mistake on the part of the College in uploading the details of the petitioner by reason of which the petitioner has not been able to take benefit of the said Memorandum. After hearing learned counsel, this Court is of the view that the writ petition may be disposed of

with a direction on the petitioner to make a comprehensive representation before the Director of Public Instruction within two weeks from date. The Director of Public Instruction shall then dispose of the representation of the petitioner by way of a reasoned order within four weeks from the date of receipt of such comprehensive representation after hearing the petitioner and the concerned College. A copy of the reasoned order shall be made available to the petitioner within a week from the date on which such reasoned order is passed.

It may be noted that the concerned College, being the material respondent in the matter, is not represented today.

The petitioner is requested to communicate a copy of this order to the College.

WPA 3169 of 2022 is disposed of in terms of the above.

Since no affidavit is called for, allegations made in the writ petition are deemed to have not been admitted.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
