The West Bengal State Electricity Distribution Company Limited and others (Via Video Conference) Mr. Anindya Bose, Mr. Vishak Bhattacharya, Ms. Ruchira Chatterjee, Mr. Diptendu Mandal, Mr. Nikhil Kumar Gupta .... for the petitioners Mr. Sumit Ray .... for the WBSEDCL Since the present dispute arises in respect of a bill in respect of alleged previous dues of the petitioners, the matter ought to be decided by the concerned Grievance Redressal Officer (GRO), who is the appropriate forum under the prevalent Regulations framed by the West Bengal Electricity Regulatory Commission.

The affidavit-in-opposition filed by the respondents be kept on record.

However, in view of the proposed reference to the appropriate forum, this court has not entered into the merits of the respective contentions of the parties at all.

Hence, WPA No.2918 of 2017 is disposed of by granting liberty to the petitioners to refer the dispute to the concerned GRO within a week from date. If so referred, the GRO is requested to decide the dispute in accordance with law upon giving adequate opportunity of hearing to all the interested parties, including the petitioner and the respondents, as expeditiously as possible, preferably within four weeks from the date of such reference.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
