Kausik (Rejected) CRM (M) 520 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Maipith Coastal Police Station Case No. 81/2024 dated 01.10.2024 under sections 126/65(1)/351(1) of the BNS, 2023 and Section 6 of the POCSO Act.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year and 10 months and till date charges have not been framed. Further, petitioner has been falsely implicated as even the victim has not taken the name of the petitioner.

Learned advocate for the State opposes the prayer for bail and submits that although there has been delay in the present case, but the accusations, as is reflected from the statement of the victim, is heinous. Victim happens to be a specially abled child.

Learned advocate for the defacto complainant is present and opposes the prayer for bail.

I have taken into account the period of custody of the present petitioner. There are various reasons which have been assigned, but without entering into the same, at this stage, I am not inclined to release the petitioner on bail. Learned Trial Court is to ensure that on the next date, the stage of charges are overcome and the victim is examined at the earliest.

At this stage, CRM (M) 520 of 2026 is dismissed. Memorandum of Evidence submitted be kept with the record.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
