2356 of 2010 has been transferred by the learned Chief Judicial Magistrate to the Court of learned Judicial Magistrate, 4th Court, Alipore.

This Court had directed that the matter to be heard afresh by the Magistrate concerned who appears to be the Judicial Magistrate, 6th Court, Alipore.

It is submitted by the learned counsel appearing for the petitioner that as the cases relate to the same principal case, there might be a conflict of decision which

may prejudice the parties in the case . As such prays for necessary direction that all the Misc. cases be heard by the same Magistrate.

Considering the prayer, CRAN 2 of 2025 is disposed of with the direction that the learned Chief Judicial Magistrate, Alipore shall pass necessary directions so as to ensure that all Misc. execution cases are heard by the same Court.

Liberty is granted to the petitioner to move before the learned Chief Judicial Magistrate, Alipore with a server copy of this order.
