The petitioner is the owner of Plot No. 472 under Mouza China J.L. No. 353, he has a registered submersible pump in his said plot of land.
The petitioner is alleging that the private respondent no. 6 has installed another submersible pump within 200 ft of the said existing Pump, which offends the mandate of the judgment passed by the learned Single Judge of this Court in the case of Kartick Chandra Mondal -Vs- Chairman WBSEB & Ors. reported in 2007 (4) CHN 579.
The petitioner, ventilating his said grievance, has made a representation before the Chairman of the District level authority constituted under Section 4 of The West Bengal Ground Water
Resources (Management, Control and Regulation) Act, 2005. The said representation forms part of the writ petition being Annexure 'P-3'.
The petitioner is praying disposal of the said representation.
The Chairman of the District level authority, the respondent no. 2 herein, is directed to consider or dispose of the said representation as expeditiously in accordance with law, either by himself or may relegate it for disposal to any of the members of the said District level authority, if necessary, after giving the petitioner and all concerned opportunity of hearing.
W.P.A. 3905 of 2021 is disposed of with the above terms without any order as to costs.
