1. Learned counsel appearing for the petitioner submits that this is a second application for anticipatory bail because of change of material circumstances. After the earlier rejection of the petitioner's application, a co-accused was granted bail by a coordinate Bench of this Court. In that order, the coordinate Bench noticed certain defects in investigation. Further investigation was directed to be monitored by the Additional Superintendent of Police/SDPO.
2. Learned counsel appearing for the State strongly opposes the prayer for anticipatory bail. She submits that the said order has no bearing, on the standing of the petitioner vis-à-vis this case. The post-mortem doctor was directed to be made a witness and there was mention about another person, not recorded as witness in the charge sheet. So far as the materials available against the petitioner are concerned, they remain the same.
3. Considering the above, I do not think that there is any material or substantial change in circumstance to entertain the second application for anticipatory bail.
4. Accordingly, the same is dismissed as not maintainable.
5. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
