There appears to be an error in the name of the petitioner appearing in the daily list. The name of the petitioner should be Saoud Hossain Molla instead of Sk. Koidul Islam.

It is fairly submitted on behalf of the parties that this matter relates to splitting of load of electricity connection.

Advocate appearing on behalf of the CESC Limited submits the petitioner has an alternative efficacious remedy available under Clause 14 of the Regulation 53 of the West Bengal Electricity Regulations.

In view of the statutory remedy available to the petitioner under Clause 14 of the Regulation 53 of the West Bengal Electricity Regulations the petitioner is granted liberty to approach the Ombudsman by way of filing an application within four weeks from date. If such application is made by the petitioner within four weeks from date before the Ombudsman, the Ombudsman is requested to consider and dispose of the same after giving an opportunity of hearing to the petitioner and all other

affected parties within two weeks from the date of filing of such representation.

It is made clear that the Ombudsman will not be influenced by any observation made in this order and the Ombudsman is at liberty to act in accordance with law. With the aforesaid directions this petition being WPA No. 3920 of 2021 stands disposed of.

There shall, however, be no order as to costs. (Ravi Krishan Kapur,J)
