Learned advocates for the petitioner and the opposite party no.2 are present.
Ms. Faria Hossain, learned advocate appearing for the State files a report of the concerned officer of Shakespeare Sarani Police Station enclosing a letter addressed by the complainant/opposite party no.2 to the Officer-in-Charge, Shakespeare Sarani P.S.
and a statement of the complainant/opposite party no.2 recorded under Section 161 of the Code of Criminal Procedure. The said report dated 27.09.2021 be kept with the record.
The statement as well as the letter reveals that amicable settlement has taken place between the parties and the complainant/opposite party no.2 is not interested to
pursue the case being Shakespeare Sarani Police Station Case No. 218 of 2017 dated 01.07.2017.
Having regard to the dispute and differences being private and personal in nature, I am of the view that no useful purpose would be served by continuing with the litigation as the chances of conviction are very bleak in this case.
It has further been submitted by the learned advocate appearing for the State that final report has been filed before the jurisdictional court praying for discharge of the accused persons.
As such, all further proceedings relating to Shakespeare Sarani Police Station Case No. 218 of 2017 dated 01.07.2017 are hereby quashed.
Accordingly, the prayer advanced in CRR 313 of 2018 along with CRAN 3 of 2020 (Old No. CRAN 427 of 2020) is hereby allowed.
