Learned advocate appearing for the petitioner submits that the private respondent nos.7 and 8 are obstructing the common pathway. To that effect, information was lodged with the Officer-in-Charge, Junput Coastal Police Station. In spite of such information being available, no action has been taken by the concerned authorities.

Learned advocate appearing for the State submits that since the nature of the complaint is such that there is a dispute with regard to the egress and ingress, G.D. Entries have been registered and appropriate vigil has been kept.

Learned advocate for the respondent nos.7 and 8 denies and disputes each and every allegation

made by the petitioner in the writ petition so far as the issues relating to egress and ingress is concerned. In view of the fact that presently the petitioner and the private respondents are in an inimical relationship and, as such, there is allegations and counter allegations over the usage of the pathway, I direct the police authorities to keep a strict vigil and ensure that no breach of the peace takes place. Police authorities would also ensure that no untoward incident should take place over the issues relating to the pathway or the common passage which has been made the subject matter of the present writ petition.

With the aforesaid observations, WPA 3318 of 2024 is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
