Mr. Ivan Roy Mr. Debangshu Bandhu Mr. Supran Dey ...for the petitioners This application under Article 227 of the Constitution of India is at the instance of the plaintiffs praying for a direction upon the learned Civil Judge (Jr. Div.), 5th Court at Alipore to dispose of the Ejectment Suit No.96 of 2022 expeditiously.

From the order sheets appended to the civil revision application this Court finds that issues have already been framed on December 2, 2024 and February 7, 2025 was fixed for peremptory hearing.

In view of order sought and proposed to be passed there is no necessity to direct issuance of notice upon the opposite parties. However, the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or their learned advocates representing them before the learned Trial Judge.

The learned advocate appearing for the petitioner submits that March 11, 2025 has been fixed for peremptory hearing.

In the light of the submissions made by the learned advocate for the petitioner CO 514 of 2025 is disposed of by requesting the learned Civil Judge (Jr. Div.), 5th Court, Alipore to dispose of Ejectment Suit No.96 of 2022 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
