1. From the report of the department, it is seen that administrative notice was duly served upon the petitioner as well as opposite party no.2.

2. Learned advocate appearing on behalf of the opposite party no.2 is present in response to administrative notice.

3. Mr. Bidyut Kumar Roy, learned advocate appearing on behalf of the State has submitted a report wherefrom it is seen that the case is already proceeded for evidence after framing of charge.
