No.23 PG/KS C.R.A. 74 of 2011 Ambar Ali Molla @ Ombar Ali Molla -Vs.- The State of West Bengal Mr. Kaushik Biswas ....For the Appellant Mr. Adil Badar .....For the State This appeal has been filed by the appellant against a judgment and order of conviction dated 6th December, 2010 passed by the learned Additional District & Sessions Judge, Fast Track, 3rd Court, Bichar Bhawan convicting the appellant for the offence punishable under Section 397 of the Indian Penal Code and Section 25(IB)(a) of the Arms Act and sentencing him to suffer rigorous imprisonment for seven years and to pay a fine of Rs.2,000/-.

During pendency of the matter, a direction was given to issue an Administrative Notice and on 12th June, 2025, the notice has been served upon the appellant through the learned Chief Judicial Magistrate, 24 Parganas (South) and the compliance report received to that extent reveals that the sole appellant, Ambar Ali Molla @ Ombar Ali Molla has expired and a copy of the Death Certificate to that extent is also annexed.

Copy of the Death Certificate reveals that the Date of Death is 17th October, 2018.

Mr. Kaushik Biswas, learned advocate appearing on behalf of the appellant and submits that he had no contact with his client. In view of the above facts and circumstances, there is no occasion to allow the matter to be pending, since the appeal has already abated. Hence, this criminal appeal stands disposed of as abated. Let a copy of this order be sent to the learned Trial Court for necessary information.
