T. S. SIVAGNANAM, CHIEF JUSTICE.:

1. This intra court appeal has been filed by the Eastern Coal Fields Limited is directed against the order dated 9th January, 2025 in WPA 24137 of 2024.

2. The facts of the case clearly demonstrate that the appellants have been dragging on the claim made by the writ petitioner for payment of monthly monetary cash compensation in terms of the National Coal Wages Agreement on account of the demise of her husband who died in harness while working in the coal mines of the appellants.

3. As rightly pointed out by the learned Single Bench what the appellants seek for is to re-verify certain documents which were given by the writ petitioner about 27 years ago and the appellants themselves have lost track of certain documents in their office files.

4. Further we note that the documents produced by the writ petitioner, namely, death certificate of her late husband issued by the

Asansol Municipality and the relationship certificate issued by the concerned Prodhan continues to remain valid.

5. Therefore, on hyper technical grounds the appellants cannot deny monthly monetary cash compensation (MMCC).

6. Hence, we find no grounds to interfere with the order passed by the learned Single Bench.

7. Accordingly, the appeal fails and dismissed.

8. The directions issued by the learned Single Bench be implemented within a period of six weeks from the date of receipt of the server copy of this order.
