Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 10 months and charges have already been framed. It has been contended that the accusation against the present petitioner is for alleged recovery of 637 bottles of phensedyl.

Learned advocate for the State opposes the prayer for bail.

I have taken into account the overall subject matter of the case and the fact that although witness action is about to commence but 17 witnesses have been relied upon by the prosecution. Having regard to the same, I am of the view that there is no possibility of the trial concluding in near future. As such, the

prayer for bail of the petitioner be allowed. The petitioner, namely, Sk. Jakir Hossain @ Jalshad shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act, Raiganj, Uttar Dinajpur. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the district of Uttar Dinajpur without prior permission of the learned special court.

Accordingly, CRM(NDPS) 310 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
