The petitioners were arrested in connection with Bagdah Police Station Case No. 360/2022 dated 17th May, 2022 under Section 21(C) of the NDPS Act and Section 14 of the Foreigners Act. The abovementioned Police case gave rise to Case No. N-69/2022 pending before the learned Additional Sessions Judge, 6th Court at Barasat. It is submitted by the learned Advocate for the petitioners that the petitioners are in custody since 17th May, 2022. On 1st November, 2022 charge was framed against the petitioners by the learned Trial Judge. There are only nine witnesses in the charge-sheet. However, till date not a single witness has been examined though as many as five dates were fixed for recording evidence of the witnesses on behalf of the prosecution.

The learned Trial Judge is requested to take proactive step so that the witnesses on behalf of the prosecution may be brought before his Court for evidence and try to dispose of the case expeditiously maintaining his general roaster in the Court's diary.
