Mr. Arindam Jana Mr. Sumanta Das ... for the respondent Nos. 2 to 4 The report filed by the ASI of Police, Tehatta Police Station, KPD, dated 18.04.2024 stated that the appellant i.e. Sonatan Pramanik has expired on 05.01.2003 supported by xerox copy of the death certificate. Let the said report be kept on record.

The report further stated that the respondent No. 1 i.e. Bhakta Mondal to have expired on 21.06.2008. The notice to have been served upon the respondent Nos. 2 to 4. Let the said report be kept on record.

The learned advocate for the respondent Nos. 2 to 4 are present.

In the above premises, the instant appeal gets abated and accordingly disposed of.

Department is directed to sent down the lower court records forthwith.
