The present revisional application has been preferred challenging the proceedings relating to Liluah Police Station Case No. 310 of 2018 dated 20.09.2018 under Sections 498A/313/323/506/34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act pending before the learned Additional Sessions Judge, 4th Court, Howrah.
Mr. Ghosh, learned advocate appearing for the petitioner submits that so far as the present petitioner being Jyotsna Pandey is concerned, there are no allegation against her and as such the proceedings against her must be quashed.
Mr. Nandy, learned advocate produces the case diary and draws the attention of this court to the statement of the witnesses as also the victim. It has been informed that the learned trial court is yet to consider the charges.
Having regard to the stage at which the petitioner approached this court, I grant liberty to the petitioner to canvas the points of the revisional application at the stage of the consideration of charges before the learned trial court.
The learned trial court would appreciate the locus of the present petitioner in the background of the materials appearing in respect of the documents relied upon by the prosecution and arrive at its own finding without being influenced by any observation by this court.
With the aforesaid observations, the present revisional application being CRR 488 of 2020 is disposed of. All pending applications, if any, in connection with the revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
