Counsel appearing on behalf of the respondent no.14 submits that a letter dated January 8, 2021 has been issued by the Teacher-in-Charge to the appropriate authorities seeking directions in this matter. He submits that in spite of receiving the order of mutual transfer, the teacher in his school, that is, the respondent no.17 is now not willing to accept the mutual transfer. Therefore, the further course of action is required to be decided by the State authorities. In light of the above submissions, the West Bengal Board of Secondary Education being the respondent no.6 (having the power in relation to the issue in hand) is directed to act upon the letter dated January 8, 2021 after granting an opportunity of hearing to the petitioner, respondent no.17

and both the schools concerned and thereafter pass a reasoned order within a period of six weeks from date in accordance with law.

With these above observations and directions, this writ petition stands disposed of.

Since, no affidavit-in-opposition has been called for the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
