The petitioner has several complaints in respect of FIR No. 128 of 2022 and FIR No. 167 of 2022 registered by Uluberia Police Station. Several proceedings have occurred in respect of the said FIRs and investigation.

A Co-ordinate Bench has also been approached under Section 482 of the Cr. P. C. 3.

In the instant case, counsel for the petitioner only seeks the relief of returning to his house along with his family members to live in peace.

The petitioner has made out a prima facie case of assault by the private respondents and theft of his car, which has since been returned to him albeit in a dilapidated condition.

Further investigation is on in respect of the aforesaid FIRs.

The private respondents are not represented. The Financer, Mahindra Finance is present in Court.

This Court in the facts and circumstances of the case directs the Uluberia Police Station to escort the petitioner and his family members back to their residence.

For the aforesaid purpose, the petitioner shall report to the Uluberia Police Station at 2.00 p.m. tomorrow (06.06.2023).

The petitioner shall be entitled to install CCTV camera in and around his house.

10.

The report of the Uluberia Police Station is kept with the record.

11.

The instant writ petition is thus disposed of.

12.

There shall be no order as to costs.

13.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
