Patra Ms. Supriya Dubey .........for the WBCSSC Matter relates to transfer of the petitioner on the ground of distance in between present school of petitioner and her place of residence. Petitioner applied on 20th January, 2022 on Utshasree portal seeking transfer but the same could not be allowed by the school authority where petitioner is presently serving. There are four teachers at present in the school and as per relevant provisions relating to transfer of Assistant Teachers, transfer application of a teacher cannot be allowed beyond ten percent of teachers present in school.

It appears that concerned school authority has not taken decision on transfer application of petitioner in view of poor teaching strength in the school, i.e. 4, which is not contrary to the relevant provisions relating to transfer and bar relating to ten percent applies in the present case. Furthermore, on hearing the parties, it appears that this is not a transfer on medical ground. In view of aforesaid scenario, no relief can be granted to the petitioner.

Accordingly, the writ petition stands dismissed. There shall be, however, no order as to cots. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings. (Saugata Bhattacharyya, J.)
