The learned advocate for the appellant prays for withdrawal of this appeal as in view of Section 21(1)a of the Bengal, Agra and Assam Civil Court (West Bengal Amendment) Act, 2000, this appeal is not maintainable before this court with liberty to prefer an appeal before the learned District Judge.

The appeal is, therefore, dismissed as withdrawn. However, the appellant is given liberty to take appropriate steps in accordance with law. In the event, an appeal is presented before the appropriate forum within four weeks from date, the appellant may get the benefit of Section 14 of the Limitation Act. There will be no order as to costs.

Office is directed to return the certified copy of the order impugned to the learned advocate on record for the appellant upon furnishing a photocopy thereof.
