Vs.

Assistant Commissioner of Income Tax, Circle -1(1), Kolkata & Ors.

Mr. Vipul Kundalia .... for the respondents.

None appears for the appellant.

Mr. Vipul Kundalia, learned Advocate appears for the respondents. His appearance shall be regularised by the Ministry / Department. The order impugned was passed on 26th September, 2018 and the appeal was presented before this Court on 11th February, 2020. Till date, the defects pointed out by the Additional Stamp Reporter have not been rectified. Further, the writ petition itself was filed aggrieved by a condition imposed by the appellate authority while entertaining an appeal for grant of stay.

Thus, it appears that the appellant is not interested in pursuing the matter.

Hence, the appeal as well as the connected applications are dismissed for non-prosecution. No order as to costs.

Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
