It appears from the submissions and the instructions received from the North 24-Parganas, District Primary School Council that the petitioners participated in the recruitment process of Primary School Teachers in the year 2009. All the petitioners belong to the Reserved Category.
The petitioner No. 1, Mahananda Sardar secured 18.18 marks, petitioner No. 2, Monotosh Mandi secured 19.78 marks, petitioner No. 3, Parul Sardar secured 16.43 marks, petitioner No. 4, Rupchand Murmu secured 15.18 marks, petitioner No. 5, Shakti Raj Mandi secured 14.13 marks and petitioner No. 6, Anima Sardar secured 15.89 marks.
The marks obtained by the aforesaid petitioners are below the marks secured by the last empanelled candidate in the Scheduled Tribe category in Bengali Medium i.e. 20.63 marks.
The Council has replied to the RTI query of the petitioner Mahananda Sardar on 2nd March, 2022, Parul Sardar on 2nd March, 2022 and Rupchand Murmu on 15th February, 2022.
It appears from the aforesaid instruction that the petitioners could not be empanelled as they secured marks less than the marks obtained by the last empanelled candidate.
In view of the above, the prayer of the petitioners to issue appointment letters in their favour can be granted. The writ petition fails and is hereby dismissed. Instruction given by the North 24-Parganas District Primary School Council be retained with the records. Urgent certified photo copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
