....for the petitioners Mr. Arindam Chattopadhyay Ms. Lipika Chatterjee .......for the State Petitioners are claiming remuneration from the month of January, 2020. According to petitioners, they were cooking mid-day meal along with others in Satyapriya Roy Smriti Belgacchi Junior High School, District -Uttar Dinajpur and in spite of working as cooks in the mid-day meal project remuneration was not paid to them from January, 2020. In this regard, representation has been made on 21st September, 2020 before the Block Development Officer, Karandighi, District - Uttar Dinajpur.

However, such prayer of petitioners is opposed by learned advocate representing State respondents relying upon written instruction of the concerned Block Development Officer which is placed before this Court and the same is taken on record. It is submitted that regularly amount for payment of remuneration was released but petitioners in whose names account was lying in bank on taking advantage of their position misused remuneration amount which was required to be released in favour of others who were engaged in cooking mid-day meal. In view of aforesaid scenario, the present writ petition is disposed of by directing the Block Development Officer, Karandighi, District - Uttar Dinajpur, being respondent no.

5 to take decision on representation of petitioners dated 21st September, 2020 by six weeks from date of communication of this order after granting opportunity of hearing to one of the representatives of petitioners and school authority and communicate his decision to the parties by one week thereafter. There shall be, however, no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings. (Saugata Bhattacharyya, J.)
