Order No. 2 dated December 2, 2022 passed by the learned Sessions Judge, Hooghly in Criminal Misc. Case No. 2068 of 2022 is in assailment in this application for cancellation of anticipatory bail.

By such order, the learned Judge took note of the statements of witnesses appearing in the case diary. He took note of the statement of the doctor. He also took note of the statement recorded under Section 164 of the Code of Criminal Procedure. He noticed the fact that the statement of the defacto complainant indicated that there was an old rivalry in between the parties. He, therefore, concluded that there was a possibility of exaggeration of allegation in the First Information Report. He, thereafter, proceeded to grant anticipatory bail to the private opposite party.

The impugned order contains reasons. We were not shown any material to arrive at a finding that the impugned order is perverse.

In such circumstances, we find no reason to interfere with the impugned order.

CRM (DB) 603 of 2023 is dismissed.
