Learned advocate for the petitioner submits that the petitioner is in custody for 1 year 3 months and the subject matter of the case relates to alleged recovery of 600 bottles of Phensedyl along with Rs. 22.7 lakh. The petitioner has been implicated in the present case on the basis of the statement of co-accused and the alleged recovery are from different persons. The petitioner is better placed than the other accused person who has been granted bail in CRM (NDPS) 421 of 2026. 2.

Learned advocate for the State opposes the prayer for bail.

I have taken into account the materials appearing in the case diary and I find that the petitioner is better placed than the other accused person who has been granted bail in CRM (NDPS) 421 of 2026. As such, I am inclined to grant bail to the petitioner.

Accordingly, the petitioner namely Safikul Islam be released on bail upon furnishing a bond of Rs.20,000/- with two

sureties of like amount each, one of whom must be local to the satisfaction of the learned Special Court cum Additional District Judge, Fourth Court, Malda. If on bail, the petitioner shall be physically present on each and every date of hearing before the learned Special Court and shall not leave the district of Malda without prior permission of the trial court.

In the event he fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail automatically without reference to this court. 6.

With the aforesaid observation, CRM (NDPS) 330 of 2026 is allowed.
