2021-03-01Hon'Ble Justice Sabyasachi Bhattacharyya2 pages

1st March, (AK) W.P.A. 2504 of 2020 With IA No: CAN 1 of 2020 (Old No: CAN 1861 of 2020) Pradip Kumar Dutta & Anr.

Vs.

Employees Provident Fund Organisation & Ors.

Mr. Somnath Ghoshal Mr. Amar Krishna Saha ...For the Petitioners.

Md. T.M. Siddiqui ...For the Respondent no.3.

The writ petitioner submits that the respondent no.3 has been sitting tight over the representations given by the writ petitioner regarding disposal of the assets of the petitioner in respect of the loan in-question in order to meet the dues from the petitioner.

Learned counsel for the respondent no.3 fairly submits that there are several legal impediments in complying with such representation at the present juncture. However, four weeks' time is sought to decide on the representation.

Accordingly, W.P.A. 2504 of 2020 is disposed of by directing respondent no.3 to consider the representation, of the petitioner annexed at page-36 of the writ petition, within four weeks from date and to intimate the decision of respondent no.3 to the petitioner immediately thereafter.

CAN 1861 of 2020 stands disposed of as infructuous in view of the above order.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
