In this application learned advocate appearing on behalf of the petitioners prays for disposal of the application under Order 39 Rule 4 of the Code of Civil Procedure, which is kept pending in the Court of learned Civil Judge (Junior Division), 1st Court, Barasat for a considerable period and it is also submitted that next date of hearing of that application has been fixed on 03.03.2023.

I am of the opinion that prayer of this revisional application does not demand any notice to be served upon the opposite parties.

Service upon the opposite parities is thus dispensed with.

Considering all facts and circumstances as it appears available from the record I request to learned Trial Judge to dispose of the application under Order 39 Rule 4 of the Code of Civil Procedure positively on 03.03.2023, without giving any adjournment to any of

the parties to this suit.

Learned advocate appearing on behalf of the petitioners is at liberty to bring the order to the notice of the learned Trial Judge.

With this observation and direction, the revisional application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
