Court No.06 265719 CO 524 of 2025 Sri Radheshyam Lohia -Vs- Benchmark Lemon Arrow Inn Mr. Animesh Paul Ms. Susmita Ghorai Ms. Aindrila Chatterjee .....For the Petitioner This application under Article 227 of the Constitution of India is at the instance of the defendant praying for a direction upon the learned Civil Judge (Junior Division), 3rd Court at Howrah to dispose of the application under Order VII Rule 11 of the Code of Civil Procedure in Title Suit No. 998 of 2024 expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of notice upon the opposite party. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application, along with a copy of this order, upon the opposite party or his learned advocates representing him before the learned Civil Judge.

From the order-sheet appended to this application, this Court finds that 29th April, 2025 has been fixed for hearing the application under Order VII Rule 11 of the Code of Civil Procedure.

In view thereof, CO 524 of 20225 is disposed of by requesting the learned Civil Judge (Junior Division), 3rd Court at Howrah to take up the hearing of the said application on the next date fixed i. e. 29th April, 2025, if the same is otherwise ready for hearing and dispose of the same, without granting any unnecessary adjournment to either of the parties.

With the above direction CO 524 of 2025 stands disposed of.
