Petitioner is aggrieved by the mode and manner of investigation.

I have perused the case diary and I find that the investigation has been concluded by the police authorities in connection with Baranagar P.S. Case No.434 dated 29.06.2023. The Investigating Officer has in fact in his opinion in the brief facts of the case expressed his observations and findings.

Since a final report has been submitted before the jurisdictional court, I grant liberty to the petitioner to approach the jurisdictional court, if so advised, by taking out an appropriate application under Section 173(8) of Cr.P.C. or under Section 193(9) of the BNSS. In case such an application is preferred before the jurisdictional Magistrate,

jurisdictional Magistrate will dispose of the same preferably within a period of 45 days of filing of such application.

With the aforesaid observations, WPA 3367 of 2024 is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
