The petitioner has preferred the present writ petition alleging unauthorized construction at plot no. 228E, Talpukur, P.S. - Patuli, P.O. - Baghajatin, Kolkata, at the instance of respondent no. 7. It is the case of the petitioner that the petitioner's land has been encroached upon by the respondent no. 7 and a two storied building and a mobile tower has been constructed illegally on the land measuring about 14 1⁄2 cottah situated at premises no. 228E, Talpukur, P.S.- Patuli, Kolkata- 700086, Ward - 101, Br-XII under Kolkata Municipal Corporation and is being used as a

club in the name and style as "Talpukur East Friends Club" without having any valid license.

Learned Counsel for the petitioner states that he had made a representation alleging such unauthorized construction being carried out on the abovementioned premises on 12.12.2024.

Learned Counsel for the respondent Municipality states that no such communication has been received by the corporation so far. Nevertheless the corporation is ready and willing to decide the representation of the petitioner dated 12.12.2024 after affording an opportunity of personal hearing to the petitioner as well as any other interested party within a period of four weeks from the date of communication of this order.

In view of the submission made by the learned Counsel for the respondent, the petitioner does not wish to press the present writ petition at this stage. 6.

In terms of the above direction, the present writ petition is disposed of.

There shall be no order as to costs.

Let urgent Photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
