The grievance of the petitioner is that the private respondents constructed a boundary wall blocking egress and ingress of the petitioner.
The report submitted in Court shows that there are pending civil disputes between the private parties over the issue of construction of the boundary wall. There is also proceeding under Section 144 of the Criminal Procedure Code.
Apparently, there are civil disputes between the private parties. The private parties at liberty to have their civil disputes resolved before the appropriate forum. The report of the police states that the police received complains from time to time which were looked into. The police submitted a prosecution under Section 107/116 of the Criminal Procedure Code. The police registered a complain as First Information Report on October 4, 2019
and on completion of investigation submitted chargesheet in respect thereof.
The police acting in the manner as noted above, further interference by the writ court is not called for. WPA 2535 of 2020 is disposed of accordingly.
