30.01.2024 Serial no. 4 [G.S.D] CRR 499 of 2023 In the matter of : Rajarshi Dutta ... ... Petitioner The revisional application was preferred challenging the order dated 19.12.2022 passed by the ld. Fast Track, 3rd Court, Barrackpore in Criminal Revision Case No. 325 of 2022.

The said revisional application before the Sessions Court was filed in connection with M.P. Case No. 2686 of 2021.

The records of the case reflect that earlier an accommodation was sought for. Today, when the revisional application has been called, none appears on behalf of the petitioner.

On perusal of the order, I find that the subjectmatter of the revisional application relates to a proceedings under section 144(2) of the cr.p.c.

Having considered that the original proceeding being M. P. Case No. 2686 of 2021 has become infructuous by the efflux of time, no interference is called for. The ld. Magistrate is directed to drop the proceedings if the same has not already been disposed of.

With the aforesaid observations, CRR 499 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.

Urgent Photostat certified copy of this order, if applied for, be supplied to the parties, subject to compliance with all requisite formalities.
