Uttam Chand Mazumder v. State Of West Bengal And ORS.
12-02-2025 Item No.59 ML Subrata Bhattacharyya IN THE HIGH COURT AT CALCUTTA Constitutional Writ Jurisdiction Appellate Side AR(C) WPA No.3393 of 2024 Uttam Chand Mazumder -vsThe State of West Bengal & Ors.
Mr. Haradhan Mondal ...for the petitioner Mr. Rajarshi Basu Mr. Ananda Dulal Sarkar ...for the State 1.
The grievance of the petitioner is that he is unable to sell his land as the record of rights wrongly mentions the same to be a vested land.
2.
Learned counsel for the petitioner submits that the petitioner was able to obtain an order from the competent forum declaring that the vesting was illegal. Even thereafter, the record of rights has not been corrected. Because of noncorrection of the record of rights, the land of the petitioner could not be sold.
3.
The petitioner has made a representation before the Inspector General of Registration and prayed for consideration of the same.
4.
From the submission made on behalf of the respective parties and on perusal of the materials on record, it appears that the petitioner is aggrieved by the recording of vesting of his land in his record of rights.
5.
In my opinion, the writ court cannot resolve the petitioner's grievance.
6.
It will be open for the petitioner to approach the
competent forum for correction of his record of rights in accordance with law, if so advised. 7.
The writ petition is disposed of.
8.
Affidavit of service is taken on record.
9.
All parties are to act on the server copy of this order duly downloaded from the official website of this Court.
10.
Certified copy of this order, if applied for, shall be made available to the parties.
