15.02.2023 sdas rejected C.R.M. (NDPS) No. 257 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Bhagwangola Police Station Case No. 85 of 2021 dated 12.02.2021 under Sections 20(b )/21(c )/29 of the NDPS Act.

And In Re : Sonarul Islam @ Sonarul Sk. ..... petitioner Mr. Pradip Kumar Kundu ... for the petitioner Mr. Saryati Datta ... for the State Learned Counsel for the petitioner submits he is in custody for two years. There is inordinate delay in trial. He prays for bail.

Learned Counsel for the State opposes the prayer for bail and submits charge has already been framed.

We have considered the materials on record. Statements of the witnesses and contemporaneous document show recovery of 75 bottles of phensedyl syrup containing codeine phosphate and 1 kg. of ganja from the possession of the petitioner which are above commercial quantity. Under such circumstances, we are not inclined to grant bail to the petitioner. The application for bail is, thus, rejected.

Trial court is directed to conduct the trial as expeditiously as possible and conclude the same at an early date

without granting unnecessary adjournment to either of the parties.
