I have considered the averments in the application and am satisfied that the petitioner was unable to be represented due to sufficient cause. The order dated 18.02.2026 stands recalled, WPA 3448 of 2026 is restored to its original file. In view of the above, CAN 1 of 2026 stands disposed of. WPA 3448 of 2026 By consent of the parties, the above writ petition is taken up for hearing.

The grievance of the petitioner is directed against an illegal connection being provided to the private respondents.

On behalf of the WBSEDCL, it is submitted that the electricity connection has been provided to the private respondents after compliance with all statutory formalities and payment of necessary fees. There was no objection by the petitioner at the relevant time when providing such connection. On behalf of the petitioner, it is submitted that there are pending civil disputes by and between the petitioner and the private respondents. The private respondent is a rank trespasser in the premises.

In view of the above facts, WPA 3448 of 2026 stands disposed of by clarifying that the grant of the electricity connection shall not create any equity in favour of the private respondent insofar as civil disputes are concerned in particular in Title Suit No. 70 of 2025 pending before the learned Civil Judge (Jr.

Division), Additional Court, Krishnanagar.
