The petitioner was admitted in BCA (Honours) course in the year 2019 under the respondent no. 3, the Techno India University. After about six months from the commencement of the course, it was found that the petitioner was not eligible to take admission in the course. The University insisted that the petitioner should change his subject from BCA to BBA.

The petitioner was not willing. He filed this writ petition before this Court against the respondent no. 3 seeking a compensation of Rs. 1 crore.

Fortunately, it has been submitted on behalf of the University that it is willing to refund the course fees

of Rs. 65,000/- together with simple interest at the rate of 6% per annum.

The petitioner agrees to such proposal.

Accordingly, this writ petition is disposed of with a direction upon the respondent no. 3 to refund the said sum of Rs. 65,000/- together with simple interest at the rate of 6% per annum to be calculated from the date of deposit of fees to the date of refund to the petitioner. Additionally, the University will pay Rs. 10,000/- as litigation cost to the petitioner. Let such payments be made within a period of four weeks from date.

With the above direction, WPA 2553 of 2020 is disposed of.
