Mr. Sandip Kr. Mondal, Mr. Sumit Routh, Ms. Ritika Yadav ...for the petitioner By this application, the Petitioner has challenged the order dated 21st January, 2026 by which warrant of arrest was issued against the petitioner.

Being aggrieved by the aforesaid order, learned Counsel for the petitioner submits that without giving opportunity to the surety to produce the accused person on the next date, the Court below has straightaway issued warrant of arrest against the petitioner. However, he made an innocuous prayer that liberty may be given to him so that he may surrender before the Court below. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer, the opposite party/State will have no cause to prejudice and, as such, the service of copy of application upon the opposite party stands dispensed with. Having considered the submissions made by heard learned Counsel for the petitioner, the instant application being CRR 762 of 2026 is hereby disposed of by giving liberty to the petitioner to surrender before the Court below within a period of four weeks. In

the event of such surrender by the petitioner before the Court below, it will dispose of such application in accordance with law without getting influenced by any observation made herein. The impugned order dated 21.01.2026 by which the Court below had issued warrant of arrest against the petitioner shall be stayed for a period of four weeks or till the petitioner surrender before the Court below, whichever is earlier.
