The case was initiated in the year 2014 and charge-sheet was submitted before the jurisdictional court. The warrant of arrest was not being executed and the matter was pending unnecessarily before the learned CJM, Alipore.

A report was called for. Mr. Arijit Ganguly, learned advocate appearing for the State has submitted a report wherein the accused/opposite parties were arrested and were produced before the learned Magistrate and have been granted bail till 30th September, 2023.

The accused/opposite parties having already been traced and date has been fixed on 30th September, 2023, I direct that if copies have not been supplied, copies be supplied to the accused/opposite parties on 30th September, 2023.

Petitioner is directed to hand over a copy of the revisional application upon the learned advocate appearing on behalf of the private opposite parties.

More than nine years have passed since the initiation of the case. Accordingly, learned CJM, Alipore is directed to take up the criminal case in his own file and fix one date in every fortnight so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

So far as the bail is concerned, the learned CJM, Alipore would consider the same in accordance with law, but with condition that the accused persons physically appear before the court on the date so fixed and do not deter the progress of the trial. All efforts must be taken for concluding the trial at the earliest. With the aforesaid observations, CRR 503 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
