01.08.2023 Sl.43 Ct.34 (S.R.) The present revisional application is against an order of acquittal passed by the appellate court. According to the provisions of CrPC, the petitioner ought to have preferred special leave to appeal.

Mr. Apalak Basu, learned advocate appearing for the petitioner submits that he intends to prefer such special leave to appeal challenging the order passed by the appellate court. Accordingly, CRR 504 of 2023 is dismissed as not pressed. The petitioner is granted liberty to prefer special leave to appeal.

In case, there is any delay in preferring the special leave to appeal the period, which has lapsed would be taken into consideration for pendency of the revisional application because of an inadvertent advice/mistaken belief.

Department is directed to return the certified copy to the advocate on record of the petitioner on the same being replaced by photostat copy.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
