The petitioner's application for transfer was rejected by the Baribhanga Bamacharan Vidyapith on the ground that she is a single teacher. It appears that the said rejection is contrary to the circular dated 22nd September, 2021, issued by the State.

In that view of the matter, the head of the school, namely, Baribhanga Bamacharan Vidyapith shall forward the petitioner's application to the D. I. of Schools, who shall consider the same in terms of the notification dated 3rd January, 2022 which has notified the earlier circular dated 22nd September, 2021.

The aforesaid process may be completed within a period of six weeks from date and a reasoned order should be passed and put up on the portal.

With the aforesaid observations, the writ petition is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
