It is submitted on behalf of the petitioner that his electricity connection has been disconnected without authority of law and the provisional assessment bill is liable to be struck out.

On behalf of WBSEDCL, it is submitted that this is a case of the petitioner having been found to have been committing theft by direct hooking. A criminal complaint has also been filed under Section 135(1)(a) of the Electricity Act, 2003 and the petitioner is alleged to be pilfering electricity. The provisional assessment order justifies no interference at all. The petitioner has been unnecessarily seeking adjournments of the hearing of the final assessment proceedings.

In view of the above submissions made on behalf of the parties, WPA 3431 of 2026 stands dismissed on the ground of maintainability.

Liberty is granted to the petitioner to take all available points in the final assessment proceedings.

It is made clear that there has been no adjudication on the merits of the case and all issues are left open to be decided in accordance with law.
