It is submitted on behalf of the petitioners that their electricity connection has been disconnected without authority of law and the provisional assessment bill is liable to be struck out.

On behalf of WBSEDCL, it is submitted that this is a case of the petitioner having been found to have been committing theft by direct hooking. A criminal complaint has also been filed under Section 135(1)(a) of the Electricity Act, 2003. The provisional assessment order justifies no interference at all. The petitioner is unnecessarily seeking adjournments of the

hearing insofar as the final assessment proceedings are concerned.

In view of the above submissions made on behalf of the parties, WPA 3432 of 2026 stands dismissed on the ground of maintainability. The petitioner has an alternative remedy which is pending.

Liberty is granted to the petitioners to take all available points before the appropriate authorities.

It is made clear that there has been no expression on the merits of the case and all issues are left open to the Appropriate Authority to be decided in accordance with law.
