15.02.2023 sdas rejected C.R.M. (NDPS) No. 262 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Nowda Police Station Case No. 135 of 2021 dated 14.06.2021 under Sections 22(c )/29 of the NDPS Act.

And In Re : Mukles Sk. @ Bakul Sk. & Ors. ..... petitioners Mr. Tapodip Gupta ... for the petitioners Mr. Ranadeb Sengupta ... for the State Learned Counsel for the petitioners submits they are in custody for more than one year. There are materials on record showing recovery of 50 bottles of phensedyl syrup containing codeine phosphate from the possession of the petitioner. Eight out of eleven witnesses have already been examined. Learned Counsel for the State opposes the prayer for bail.

We have considered the materials on record. Under such circumstances and statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner. The application for bail is, thus, rejected.
