Criminal Miscellaneous Jurisdiction Appellate Side CRM (M) 468 of 2026 In Re:- An application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 arising out of Gangajolghati Police Station Case No.14 of 2025 dated 04.02.205 under Sections 331(4)/305(a) of the Bharatiya Nyaya Sanhita, 2023 pending in the Court of Additional Sessions Judge, 1st Court, Bankura.

Petitioners Mr. Subhendu Roychoudhury ..for the petitioners Ms. Shaila Afrin Mr. Kaustav Banerjee ..for the State The petitioners have been in custody for more than seven months, and the charge-sheet has already been submitted.

Having regard to the nature of the alleged offence and the period of custody already undergone by the petitioners, this Court is of the view that their further custodial detention is not necessary.

Accordingly, the petitioners, namely Sk. Sabir @ Kharu, Jagadis alias Laltu Das, and Choton Pal, are directed to be

released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand) each, with two sureties of the like amount each, one of whom must be a local resident, to the satisfaction of the learned Additional Sessions Judge, 1st Court, Bankura.

This order is subject to the condition that the petitioners shall appear before the Trial Court on each date of hearing until further orders and shall not, in any manner whatsoever, intimidate witnesses or tamper with evidence. In the event that the petitioners fail to appear before the Trial Court without justifiable cause, the Trial Court shall be at liberty to cancel their bail in accordance with law, without making any further reference to this Court.

Accordingly, the prayer for bail is allowed.

Accordingly, CRM (M) 468 of 2026 is, thus, disposed of.

Let an urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on the usual undertakings.
