Respondent No. 4 is not represented. The petitioner alleges that Respondent No. 4, a neighbor situated to the north of her premises, has undertaken construction in the common passage between the petitioner's house and that of Respondent No. 4. Counsel for the petitioner asserts that this construction was carried out without an approved plan from Konnagar Municipality.

In light of the above, I hereby dispose of this writ petition with a directive to Konnagar Municipality to conduct an inspection of the premises in question, providing due notice to both the petitioner and Respondent No. 4. Should the inspection reveal that Respondent No. 4 has engaged in unauthorised construction, the Municipality shall take immediate

action to demolish such construction, in accordance with the law.

The inspection shall conduct within three weeks from the date of communication of this order. With the aforesaid direction, WPA 3436 of 2024 is disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties on compliance of usual legal formalities.
